Abstract

The article makes a comparative study of the application of international law by the high courts of Argentina and Spain, regarding the models of transitional justice adopted in each case. In doing so, the paper adopts the theoretical and methodological approaches from Foreign Relations Law and Comparative International Law, explained in general terms in the first part. The article suggests that the degree of application of international law by the high courts of Argentina and Spain, when deciding on the possibility of criminal prosecution of crimes against humanity, is directly related to various aspects of the domestic law of each State.
