Abstract

After the approval in 2016, by the European Union, of a new derivative right related to the protection of personal data, the Civil Guard, like the rest of the institutions, organizations, companies, etc., has had to adapt the treatments that it was carrying out. effect to the new model. This model is much more demanding towards the person who processes the data, by placing the responsibility on the person in charge or in charge of treatment, not only to comply with it, but also to be able to demonstrate it. The figure of the Data Protection delegate has been created, this with a legal profile, must act independently, advising and supervising compliance by the treatments of the legal framework. The General Directorate of the Civil Guard has 55 declared data processing, both administrative and police. Its DPD, which receives numerous queries, claims, and requests for the exercise of rights every year, has seen an incessant increase in the tasks it must attend to, which undoubtedly reflects the Company’s interest in respec- ting the fundamental right to the protection of personal data.
