Abstract

On 18 March 2016, the Heads of State or Government of the Member States of the European Union decided to adopt a pact with Turkey to achieve the goal of "ending the traffickers' business and offering immigrants an alternative”. This pact established, among other things, that any irregular immigrant from Turkey arriving in European territory would be returned to Turkey. One criticism of this pact is that it seeks to confuse refugees with irregular immigrants. This would violate the rules of the 1951 Geneva Convention, its 1967 Protocol and much of the European rules on the right of asylum. Another polemic point of the Pact is the inclusion of Turkey in the list of safe countries. It would be necessary to assess whether the EU - Turkey Pact infringes the rules of international law and the rules of EU law as has been denounced by various organizations, including the Spanish Commission for Refugee Assistance or the General Council of Spanish Law.
